These terms govern your use of https://thepoisonedstore.com (the "Site") and any order you place through it. The Site is owned and operated by Star Creations India, a partnership firm registered in Haryana, India ("we", "us", "our"). By using the Site or placing an order you agree to these terms.
1. Who we are
The Poisoned Store is a brand of Star Creations India. Our registered and operating address, GSTIN and contact details are at the foot of this page.
2. Eligibility
You must be at least 18 years old, and capable of entering a contract under the Indian Contract Act, 1872, to place an order. If you are under 18 you may use the Site only with the involvement of a parent or guardian.
3. Products, descriptions and colour
We describe every product as accurately as we can. Garment photographs are taken under studio lighting and screens differ, so the exact shade you receive may vary slightly from what you see. Measurements on our size charts are taken flat and may vary by up to half an inch because garments are cut and stitched by hand.
We may change or discontinue any product at any time, and we may limit quantities on any order.
4. Prices and payment
- All prices are in Indian Rupees (INR) and are shown before GST. GST is added at checkout and shown, with every other charge, before you place the order.
- Where a product shows a struck-through price, that is the maximum retail price (inclusive of all taxes), and the price beside it is our selling price before GST. Selling price plus GST never exceeds the MRP.
- We accept UPI, debit and credit cards, net banking, wallets, and cash on delivery on serviceable PIN codes. Cash on delivery carries a charge of ₹149 plus GST.
- Payments are processed by a third-party payment gateway. We never see or store your full card details.
- Prices and offers can change without notice, but a change never affects an order we have already accepted.
5. When a contract is formed
Your order is an offer to buy. A contract is formed only when we confirm dispatch. If we cannot accept an order — the item is out of stock, the price was listed in error, the address is not serviceable, or we suspect fraud — we will tell you and refund any amount already paid in full.
6. Discount codes
Discount codes are subject to the terms stated with each offer, cannot be exchanged for cash, and unless the offer says otherwise only one code may be used per order. We may withdraw a code at any time, and we may cancel orders where a code has been obtained or used in a way it was not intended.
7. Returns, refunds and shipping
Our refund, return & cancellation policy and shipping & delivery policy form part of these terms.
8. Your account
If you create an account you are responsible for keeping your password confidential and for everything done through your account. Tell us immediately if you believe it has been used without your permission.
9. Acceptable use
You agree not to use the Site for any unlawful purpose, not to attempt to gain unauthorised access to it, not to interfere with its operation, and not to copy, scrape or resell our content or product images without written permission.
10. Intellectual property
All designs, artwork, photographs, text and the The Poisoned Store name and logo are owned by or licensed to Star Creations India and may not be reproduced without our written consent. Where a design references a third party's character or work, it is sold as a fan-made interpretation and no affiliation or endorsement is claimed.
11. Limitation of liability
To the extent permitted by law, our liability for any order is limited to the amount you paid for it. We are not liable for indirect or consequential loss. Nothing in these terms limits any liability that cannot be limited under Indian law, including your rights under the Consumer Protection Act, 2019.
12. Force majeure
We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, strikes, civil unrest, courier disruption, or government restrictions.
13. Governing law and jurisdiction
These terms are governed by the laws of India. The courts at Yamuna Nagar, Haryana have exclusive jurisdiction over any dispute, without prejudice to your right to approach a consumer forum where you live.
14. Changes to these terms
We may update these terms from time to time. The version published on the Site when you place an order is the version that applies to it.
